Terms of Service
These terms govern your use of TitleClear, operated by TitleClear (proprietor: Muthuramji Vadamalayan) (“we”, “us”). By creating an account or making a payment, you agree to them.
1. What TitleClear does
TitleClear is a self-screening tool for property documents. You upload documents for a property you are considering — sale deeds, parent deeds, encumbrance certificates, patta/chitta, survey sketches and similar — and we use automated analysis to compare identifying details such as owner names, survey numbers, extent and dates across those documents, and report where they agree and where they do not.
2. What TitleClear does not do
Specifically, we cannot and do not verify:
- Whether property tax, water, sewerage or electricity dues are outstanding. A receipt shows a payment was made, not that nothing further is owed.
- Litigation history, court orders, or pending disputes.
- Whether the documents you upload are genuine, or whether they correspond to the property you are actually being offered.
- Anything that is not visible in the documents provided.
Our results are stated in these terms inside the product itself. You must confirm anything that matters against official records and take independent legal advice before buying property. Decisions you make on the basis of a TitleClear report are yours.
3. Eligibility and your account
You must be at least 18 and legally able to enter a contract in India. Accounts are identified by an Indian mobile number verified by one-time password. You are responsible for anything done through your account, and for keeping access to that number secure.
4. Documents you upload
You must only upload documents you are legally entitled to hold and to have processed — for example, documents given to you by a seller or agent in the course of a genuine transaction. You must not upload documents obtained unlawfully, or belonging to someone else without a proper basis. We may suspend an account we reasonably believe is being used to process documents improperly.
5. Plans, quotas and validity
Plans are prepaid and grant a fixed number of property verifications within a fixed validity period, both shown on the pricing page before you pay. Unused verifications do not carry over once a plan expires, and validity is not extended by non-use. Prices are in Indian rupees and include applicable taxes unless stated otherwise.
6. Availability
We aim to keep the service available but do not guarantee uninterrupted operation. Verification depends on third-party services, and processing may occasionally fail or be delayed. Where a verification fails for reasons on our side, see our refunds policy.
7. Intellectual property
The software, interface and report formats are ours. Your documents, and the reports generated from them, remain yours; we use them only to provide the service, as described in our privacy policy.
8. Limitation of liability
To the extent permitted by law, our total liability to you for any claim connected with the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for losses arising from property transactions you enter into, including any loss of the purchase price, deposits, or opportunity — the service is a screening aid, not a guarantee of title.
9. Changes and termination
We may change these terms; material changes will be reflected in the “last updated” date and, where they affect an active plan, notified to you. You may stop using the service at any time and ask us to delete your data as described in the privacy policy.
10. Governing law
These terms are governed by the laws of India. The courts at Chennai, Tamil Nadu have exclusive jurisdiction over any dispute.
